1. Introduction
Welcome to ClickPay Africa. These Terms and Conditions ("Terms") govern your use of the ClickPay Africa services, including but not limited to mobile payment, escrow, recharge and bill payment, merchant tools, referrals, pledge management, and all other features available on our platform (web, app, or USSD). By signing up or using any ClickPay Africa service, you agree to be bound by these Terms.
2. Definitions

User: Any individual who registers and uses the ClickPay Africa platform for personal transactions (B2C).

Merchant: A registered business or individual that accepts payments via ClickPay Africa.

B2B User (Business to Business): Businesses using ClickPay Africa to manage transactions with other businesses or customers.

Escrow: A secure holding feature where funds are held by ClickPay Africa until conditions agreed upon by the buyer and seller are met.

Withdraw: The act of transferring available funds from a ClickPay Africa wallet to a linked bank or mobile account.

Send Money: A feature allowing users to transfer funds to another registered ClickPay Africa user.

Request Money: A feature allowing users to request a specific amount from another user.

Pay by Installment: A feature allowing users to split a purchase or service into smaller, scheduled payments.

Pay Bills: Paying utility or service provider bills directly from the ClickPay Africa platform.

Recharge and Get Paid: A program where B2C users earn commission when they recharge airtime/data or pay bills for themselves or others.

Membership: The status level of a user on ClickPay Africa. Free users can transact, but only upgraded members earn bonuses, commissions, and loyalty points.

QR Code: A scannable code that uniquely identifies a user or merchant account for instant transactions.

Referral Link: A unique link provided to each user upon registration, which can be shared to invite others to join the platform. Bonuses and commissions may apply.
3. Eligibility
You must be at least 18 years old to register. Minors may only use the service under the supervision of a guardian and with limited features. Users agree to provide accurate and up-to-date information.
4. User Registration and Access
Registration requires only a phone number. Users receive a referral link and a QR code upon successful signup. Merchants complete a self-onboarding form to access merchant tools.
5. Services and Features
5.1 Escrow

Buyer and seller agree to transaction terms.

Funds are held securely until both parties confirm delivery.

Disputes trigger mediation. Final decision made by ClickPay Africa.
5.2 Cashback

Users may receive cashback on eligible transactions.

Cashback is paid at the end of the month or as specified.
5.3 Installment Payments

Enables purchases or bills to be paid in parts.

Missed payments may incur penalties or service restriction.
5.4 Pledge

Users can create pledges for fundraising (weddings, events, etc.)

Contributions can be one-time or recurring.

Visibility on who has paid and pending contributors.
5.5 Recharge and Get Paid

Users earn commission on their own and their referrals’ recharge or bill payment.

Requires membership upgrade to unlock full benefits.

Monthly payout to contributors.
5.6 Referral and Membership

Free accounts can use all services.

Upgraded members earn bonuses, commissions, and loyalty points.

Referral links generate bonuses for the inviter when invitees transact.
5.7 QR Code Payments

Every user and merchant gets an auto-generated QR.

Used for receiving payments in-store or person-to-person.
6. Fees and Charges

Some transactions may include a minimal service fee.

ClickPay Africa reserves the right to adjust fees with prior notice.
7. Fraud, Security, and Suspension

ClickPay Africa uses strong encryption and monitoring tools.

Accounts found in violation (fraud, fake pledges, abuse of referral system) may be suspended or terminated.
8. Cancellations and Refunds

For Escrow: funds may be returned to the buyer if seller fails to meet agreed terms.

For Pledge: Initiators may cancel and request funds returned to contributors.

ClickPay Africa’s decision in disputes is final.
9. Notifications
Users receive SMS/email/app notifications for:

Transaction updates

Payment confirmations

Escrow status

Pledge contributions

System reminders for pending payments.
10. Data Privacy
ClickPay Africa only collects and processes data as required to deliver our services. We do not sell or misuse user data.
11. Legal Compliance
Users agree to abide by the financial regulations of their respective countries. ClickPay Africa operates under applicable local and international financial and data protection laws.
12. Limitation of Liability
ClickPay Africa is not liable for losses caused by:

User negligence (e.g. sharing PINs/passwords)

Delays caused by external payment processors

Misuse of funds by pledge initiators (unless proven fraudulent)
13. Updates to Terms
We may update these Terms periodically. Continued use after such updates implies your acceptance.
